Please read these terms carefully before using WPSafer. By accessing or using our platform, you agree to be bound by these terms.

Acceptance of Terms
By registering for, accessing, or using WPSafer (the “Service“), operated by Wp Safer, you agree to be legally bound by these Terms and Conditions (the “Terms“). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
If you do not agree to these Terms, you must not access or use the Service.
These Terms incorporate our Privacy Policy by reference. Please read both documents carefully before using the Service.

Description of Service
WPSafer is a Software-as-a-Service (SaaS) platform that provides remote WordPress site management capabilities, including but not limited to:
- Backup management — Automated and on-demand backups of files and databases for connected WordPress sites.
- Security monitoring — Malware scanning, vulnerability detection for plugins and themes, and uptime monitoring.
- Update management — Bulk plugin, theme, and WordPress core update capabilities across connected sites.
- Site dashboard — Centralized management interface for all connected WordPress installations.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Accounts & Access
To use the Service, you must register for an account and provide accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account, whether or not authorized by you.
- Notifying us immediately at support@wpsafer.com of any unauthorized use of your account.
- Ensuring that all users added to your account comply with these Terms.
You may not share your account credentials with third parties or allow others to access the Service through your account except as expressly permitted by your plan (e.g., team member seats on Agency plans).
You must be at least 18 years of age to create an account and use the Service.

Subscription & Billing
WPSafer offers subscription plans on a monthly or annual basis. By selecting a paid plan, you authorize us to charge the applicable fees to your designated payment method via Paddle, our payment processor.

- Renewals — Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
- Price changes — We reserve the right to change pricing with at least 30 days’ notice. Continued use after the effective date constitutes acceptance.
- Refunds — You may request a full refund within 14 days of any payment, no questions asked. To request a refund, contact us at legal@wpsafer.com with your order details.
- Failed payments — If a payment fails, Paddle will notify you. Continued failure may result in suspension or downgrade of your account.
- Taxes — All fees are exclusive of applicable taxes, which you are responsible for paying.
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.

Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to manage WordPress sites you do not own or have explicit authorization to manage.
- Attempt to gain unauthorized access to any part of our platform, servers, or related systems.
- Use the Service to store, transmit, or distribute malware, unlawful content, or content that infringes third-party rights.
- Reverse engineer, decompile, or attempt to extract the source code of the WPSafer plugin or backend platform.
- Resell, sublicense, or transfer your account or access to the Service to any third party without our written consent.
- Use automated scripts or bots to interact with the Service in a way that disrupts or overloads our infrastructure.
- Circumvent any plan limitations, including connecting more sites than your subscription allows.
Violation of this section may result in immediate suspension or termination of your account without refund.

Data & Backups
WPSafer provides backup functionality as a convenience feature. You acknowledge and agree that:
- You remain solely responsible for maintaining independent copies of your data. WPSafer backups are supplementary and should not be your only disaster recovery mechanism.
- Backup availability is not guaranteed. Factors such as server downtime, network issues, or plugin conflicts on your WordPress site may prevent successful backup completion.
- Backup retention is limited according to your subscription plan. Backups outside the retention window are permanently deleted.
- Upon account termination, all backups and associated data will be deleted within 90 days.
- You grant WPSafer a limited license to access, copy, store, and transmit data from your connected sites solely for the purpose of providing the Service.
Important: WPSafer is not a backup service provider in the traditional sense. We strongly recommend maintaining at least one additional backup solution independent of WPSafer.

Intellectual Property
The WPSafer platform, including the web application, WordPress plugin, source code, design, trademarks, and all related materials, are the exclusive intellectual property of Wp Safer and its licensors, protected by applicable copyright and intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and install the WPSafer plugin on your WordPress sites, solely for the purposes described in these Terms and within the limits of your subscription plan.
You retain all rights to your own content and data stored through the Service. You do not transfer any ownership rights to WPSafer by using the platform.

Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Guarantees that the Service will be uninterrupted, error-free, or free from harmful components.
- Guarantees that backup operations will complete successfully or that backup files will be recoverable.
- Guarantees regarding the accuracy of security scan results or uptime monitoring alerts.
Some jurisdictions do not allow the exclusion of certain warranties. In such cases, these exclusions apply to the maximum extent permitted by applicable law.

Limitation of Liability
To the maximum extent permitted by applicable law, Wp Safer and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, revenue, profits, or business opportunities.
- Website downtime, data corruption, or loss resulting from failed backup or restore operations.
- Unauthorized access to your account or connected sites.
- Any damages arising from third-party services integrated with the platform.
In no event shall Wp Safer‘s total cumulative liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of: (a) the total fees paid by you in the 12 months preceding the claim, or (b) €100 EUR.

Termination
By you: You may cancel your account at any time from your dashboard settings. Upon cancellation, your access to paid features will continue until the end of the current billing period.
By us: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if:
- You breach any provision of these Terms.
- We reasonably suspect fraudulent, abusive, or illegal activity on your account.
- Continued operation of your account poses a risk to our platform or other users.
Upon termination, your right to use the Service immediately ceases. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in the applicable jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

Changes to Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will:
- Update the “Last Updated” date at the top of this page.
- Send an email notification to registered users at least 14 days before changes take effect.
- Display a prominent notice in your WPSafer dashboard.
Your continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service and cancel your account.
