This document sets out, in one place, the Pre-Contract Information Form and the Distance Sales Agreement that the BUYER reads and accepts before placing an order for WP Safer. Confirming the order/payment means that both texts have been accepted.
This document is intended for buyers in the European Union / European Economic Area (and other jurisdictions with comparable consumer-protection regimes). It is drafted under the logic of the EU Consumer Rights Directive 2011/83/EU (as implemented in the buyer's home Member State) and the General Data Protection Regulation (Regulation (EU) 2016/679, "GDPR"). Buyers resident in Türkiye are covered by the separate Turkish-law version issued under Consumer Protection Law No. 6502.
Part A — Pre-Contract Information Form
A.1. Purpose
This Pre-Contract Information Form informs the BUYER, before they place an order or confirm payment, of the essential characteristics of the WP Safer subscription service and of the one-off, fixed-price site migration (concierge) service, its price, the payment method, the manner of performance, and the BUYER's right of withdrawal, in line with Articles 6–8 of Directive 2011/83/EU on consumer rights. The BUYER cannot complete an order without confirming that they have read and accepted this Form together with the Distance Sales Agreement in Part B below.
A.2. Provider (Trader) Identity
Limon Software SolutionsIstanbul, Türkiye
Email: info@wpsafer.com
Phone: +90 543 209 5970
A.3. Buyer Information
The BUYER's name, email address, and (if requested) billing details are entered by the BUYER at the time of purchase on the payment page (Polar.sh checkout) or during account creation; these details are added to the contract dynamically for each order.
A.4. Main Characteristics of the Service
Subscription service. WP Safer is a subscription service (SaaS) that allows the BUYER to remotely manage multiple WordPress sites from a single dashboard. The service includes backup of connected WordPress sites and restoration on request, installation and updating of plugins/themes, and monitoring of site status (uptime/availability). The service is a digital service supplied electronically, with no physical delivery; no shipping or delivery charge applies.
Site migration service (one-off). Sold separately from any subscription, this is a one-off, human-performed service in which the PROVIDER's team moves the BUYER's WordPress site to a new hosting provider. Scope: a single WordPress site of up to 10 GB, WordPress to WordPress. Migration of email accounts/MX records, WordPress multisite networks, and sites larger than the stated size are NOT covered by the fixed price and are quoted separately. Work can only start once the BUYER supplies access credentials (SFTP/FTPS) for the destination server after payment.
A.5. Price and Payment Method
- The current price, subscription plan, and renewal period are shown at checkout (Polar.sh) in the currency displayed there; the BUYER sees the total price before confirming payment.
- Payment is collected via the third-party payment processor Polar.sh, using the payment method chosen by the BUYER. Card details are not stored on the PROVIDER's own servers.
- The subscription automatically renews for the chosen period (monthly/annual) unless cancelled by the BUYER.
- Price changes are notified to the BUYER's registered email address at least 30 days before they take effect.
- Polar.sh acts as merchant of record for the purchase. Applicable taxes (such as VAT or sales tax) are calculated by Polar.sh according to the BUYER's country and added to the price at checkout; the BUYER sees the tax amount and the total before confirming payment.
- Site migration service: a one-off, fixed price ($300) charged once when the request is placed; it does not renew. Work beyond the scope set out in A.4 (email/MX migration, multisite, sites over 10 GB) is not included and is billed separately only if the BUYER agrees to a separate quote.
A.6. Manner and Time of Performance
Subscription: The service begins to be performed electronically immediately after payment is confirmed: the BUYER's account is opened/activated and dashboard access is provisioned. There is no shipping or delivery process.
Site migration: At checkout the BUYER expressly requests that performance begin immediately; the PROVIDER starts work (preparation, copying the existing site, requesting destination credentials from the BUYER) as soon as payment is confirmed. Performance is complete when the site is delivered in working order on the new host. There is no shipping or delivery process.
A.7. Right of Withdrawal
The first four paragraphs below concern the subscription service; the rule for the one-off site migration service is at the end of this section.
General rule (EU 14-day right): Under Articles 9–11 of Directive 2011/83/EU, the BUYER has the right to withdraw from this contract within 14 calendar days from the day the contract is concluded, without giving any reason and without incurring any penalty, by notifying the PROVIDER of the decision to withdraw (e.g. by email to info@wpsafer.com, stating the BUYER's name and account email address) before the period expires.
Immediate start of the service: WP Safer's dashboard access and management functionality begin immediately after payment. At checkout, the BUYER expressly requests that performance begin during the withdrawal period. If the BUYER then withdraws within the 14-day period, the BUYER shall pay an amount proportionate to the service provided until the PROVIDER was informed of the withdrawal (Article 14(3) of Directive 2011/83/EU), calculated as the price of the billing period divided by the number of days in that period, multiplied by the number of days the service was provided. The right of withdrawal ends once the service has been fully performed (Article 16(a) of Directive 2011/83/EU).
PROVIDER's voluntary refund commitment: In addition to, and not instead of, the statutory rights above, WP Safer commits to a full refund, on the BUYER's request, for unused subscriptions within 14 days of the first purchase date (see Terms of Service art. 6); in that case no proportionate payment is charged. After this period, no refund is issued for the remaining billing period, without prejudice to any right the BUYER has under the applicable law.
Refunds: Any amount due to the BUYER following withdrawal is reimbursed without undue delay and no later than 14 days from the day the PROVIDER is informed of the withdrawal, using the same means of payment used for the original transaction, processed through Polar.sh.
Site migration — withdrawal and refunds: The migration service is performed immediately at the BUYER's express request, given by ticking the acknowledgement box before payment. By giving that request and acknowledgement, the BUYER accepts that the right of withdrawal is lost once the migration has been fully performed (Article 16(a) of Directive 2011/83/EU) and that no refund is then due. If the BUYER withdraws after work has started but before the migration is complete, the BUYER pays an amount proportionate to the work already performed (Article 14(3)); the balance is refunded.
PROVIDER's voluntary refund commitment (migration): In addition to the statutory position above, the PROVIDER refunds the full amount where (i) the BUYER withdraws the request before work has actually started; (ii) the request turns out to fall outside the scope in A.4 and the parties do not agree a separate price; or (iii) the migration cannot be completed for reasons attributable to the PROVIDER.
A.8. Complaints and Dispute Resolution
The BUYER may direct any complaint regarding this Form or the Distance Sales Agreement in Part B to the PROVIDER at info@wpsafer.com. Consumers resident in the EU/EEA may also contact the consumer protection authority of their own country of residence.
A.9. Contract Duration, Termination and Automatic Renewal
- The contract remains in effect (indefinite term, renewing periodically) until the BUYER closes their account or cancels their subscription. A one-off site migration contract ends when the service has been performed; it does not renew and needs no cancellation.
- The BUYER may cancel their subscription at any time via the dashboard; cancellation takes effect at the end of the current billing period (no pro-rata refund for unused time within the period; for withdrawal and refunds within the first 14 days, see A.7).
- Removing a site deletes its FTP/SFTP details immediately; the site record and its access key are kept in the Trash in your panel (you can delete them permanently at any time, and if you don't they are deleted automatically after 90 days); on account closure, site records, access keys and all remaining backups are deleted within 30 days (see Terms of Service art. 10).
A.10. Accuracy and Binding Nature of the Pre-Contract Information
The PROVIDER is responsible for the accuracy of the information in this Form. The BUYER confirms electronically, before finalising the order, that they have read and accepted this Form and the Distance Sales Agreement below; without this confirmation the order cannot be completed.
Part B — Distance Sales Agreement
B.1. Parties
PROVIDER:
Limon Software SolutionsIstanbul, Türkiye
Email: info@wpsafer.com
Phone: +90 543 209 5970
BUYER: The consumer/user who is a party to this Agreement, identified by the name, email, and (if any) billing details declared during purchase on the payment page (Polar.sh checkout) or the account creation screen.
The parties have entered into this Distance Sales Agreement ("Agreement") on the following terms.
B.2. Subject and Scope
This Agreement governs the rights and obligations of the parties in connection with the sale and performance of the WP Safer subscription service, or of the one-off site migration service, ordered electronically by the BUYER through the PROVIDER's website wpsafer.com, under the consumer-protection framework applicable at the BUYER's place of residence implementing Directive 2011/83/EU. The BUYER acknowledges having received the essential pre-contract information on the service's main characteristics, sale price, payment method, manner of performance, and right of withdrawal through the Pre-Contract Information Form (Part A) before placing the order, and having confirmed this electronically.
B.3. Main Characteristics, Price and Payment Method
- WP Safer is a subscription service (SaaS) enabling remote management of multiple WordPress sites from a single dashboard: site backup and restoration, plugin/theme installation and updates, and site status monitoring.
- The current price, subscription plan and renewal period are the amount and currency shown on the payment page at the time of order; the BUYER sees and accepts this before confirming payment.
- Payment is collected through the third-party payment processor Polar.sh; card details are not stored on the PROVIDER's servers.
- The subscription renews automatically for the chosen period unless cancelled by the BUYER. Price changes are notified at least 30 days before they take effect.
- The service fee does not include any shipping/delivery charge, as it does not involve delivery of a physical good.
- Applicable taxes (such as VAT or sales tax) are calculated by Polar.sh, as merchant of record, according to the BUYER's country and added to the price at checkout.
- The site migration service is not a subscription: it is a one-off service at a fixed price ($300), does not renew, and its scope is defined in A.4.
B.4. Manner and Time of Performance
The subscription service begins to be performed electronically immediately after payment is confirmed: the BUYER's account is opened/activated and dashboard access is provisioned. For the site migration service, the PROVIDER starts work immediately after payment at the BUYER's express request, and performance is complete when the site is delivered in working order on the new host (see A.6).
B.5. General Provisions
- The BUYER acknowledges having read and understood, and having given the required electronic confirmation for, the service's main characteristics, sale price, payment method, and pre-contract information on performance, as presented on wpsafer.com.
- The PROVIDER acts in reliance on the accuracy of the personal and contact information provided by the BUYER; the PROVIDER is not liable for damage arising from incorrect or incomplete information supplied by the BUYER.
- The BUYER is responsible for the accuracy of the access credentials for the WordPress site(s) connected to the Service, and for having the authority to provide such credentials to the PROVIDER (see Terms of Service art. 3–4).
- Personal data processed in the course of providing the Service is described in the Privacy Policy, which references the General Data Protection Regulation (Regulation (EU) 2016/679, "GDPR") and sets out the categories of data processed, the legal bases relied on, the third-party processors involved (including the payment processor Polar.sh), retention periods, international transfer safeguards, and the BUYER's rights as a data subject (access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with a supervisory authority). The Privacy Policy forms an integral part of this Agreement.
B.6. Right of Withdrawal
The content of this section is identical to A.7 — Right of Withdrawal above; it is not repeated here so that a single source of truth is maintained. This includes the rule for the one-off site migration service (A.7 — site migration).
B.7. Late Payment and Its Legal Consequences
Where the BUYER's payment instrument (card, etc.) fails or the BUYER otherwise defaults on a payment obligation, the BUYER agrees to bear any resulting loss and applicable late-payment charges; the PROVIDER reserves the right to suspend or terminate the subscription in the event of default.
B.8. Entry into Force and Acceptance
The BUYER confirms electronically, at the order-confirmation step, that they have read and accepted this Agreement and the Pre-Contract Information Form; without this confirmation, the order cannot be completed and payment cannot be taken. This Agreement enters into force upon the BUYER's acceptance and the PROVIDER's confirmation of payment.
B.9. Governing Law and Competent Jurisdiction
This Agreement is governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul, Türkiye have jurisdiction over any dispute arising from this Agreement. This choice does not deprive a BUYER who is a consumer of the protection afforded by the mandatory consumer-protection rules of their country of habitual residence.
