Terms of Service

1. Parties and Acceptance

These Terms of Service (“Terms”) govern your (“User,” “you”) use of the service (“Service”) offered at wpsafer.com by Limon Software Solutions (“WP Safer,” “we,” “us”). By registering for or using the Service, you agree to these Terms. You must be at least 16 years old to use the Service.

2. Description of Service

WP Safer is a subscription service that lets you remotely manage multiple WordPress sites from a single dashboard, including:

• Backing up (backups are stored with DigitalOcean Spaces object storage, in the backup region you select for each site; new sites default to Amsterdam, Netherlands) and, on your request, restoring the WordPress sites you connect;
• Installing and updating plugins/themes;
• Monitoring site status.

We do not guarantee uninterrupted or error-free operation, but we make reasonable efforts to keep the Service available.

3. Accounts and Responsibilities

• You must provide accurate and current information when registering.
• You are responsible for keeping your account password confidential and for all activity under your account.
• You must notify us immediately of any suspected unauthorized access.

4. Managed Site Access — Important Notice

When you connect a WordPress site to the Service, we generate and store a site-specific access key used to sign management commands; this key grants administrator-level access to your site (we do not ask for your WordPress admin password itself). You may optionally also provide FTP/SFTP details. Regarding this:

• We use this access solely to perform the management actions you request (backup, restore, install/update).
• You can rotate the access key from the panel at any time; the old key stops working immediately and the site stays disconnected until you paste the new one into the WP Safer settings in wp-admin.
• You are responsible for connecting and disconnecting your sites, and for your own security practices (e.g. two-factor authentication on your site, periodic password rotation).
• You are responsible for having the authority to connect the site and for the site being yours or under your management authority.

5. Backup and Restore — Limitation of Liability

Backup and restore operations inherently carry risk. Your backups are stored with our third-party cloud providers: Hetzner (application/database, Germany) and DigitalOcean Spaces (backup files, in the backup region you select for each site; Amsterdam/Netherlands by default). Accordingly:

• While we use commercially reasonable, industry-standard methods, the risk of data loss, corruption, or temporary/permanent unavailability of your site during a backup or restore cannot be entirely eliminated. This includes risk arising from outages of our third-party infrastructure providers (Hetzner, DigitalOcean).
• We strongly recommend maintaining an independent backup strategy outside of WP Safer for critical data.
• Except in cases of our own gross negligence or willful misconduct, WP Safer is not liable, to the maximum extent permitted by law, for indirect damages (including loss of profit, data, or business) arising from backup/restore operations. Our total liability is capped at the subscription fees you paid in the 12 months preceding the event giving rise to the claim.

6. Payment and Subscription

• Subscription fees are collected via Polar.sh.
• Your plan, fee, and renewal period are as shown at checkout; unless stated otherwise, subscriptions renew automatically.
• Price changes take effect after at least 30 days’ advance notice.
• Refund policy: Full refunds may be requested within 14 days of your initial purchase for unused subscriptions. After this period, no refunds are issued for the remainder of the current billing cycle.

7. Prohibited Uses

You may not use the Service for: unlawful activity; unauthorized access to systems you do not own; distributing malware; reselling the Service; infringing intellectual property rights; or attempting to circumvent security measures.

8. Intellectual Property

The Service’s software, branding, design, and content belong to WP Safer or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service.

9. Privacy

Our processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

• You may ask us to close your account at any time by writing to info@wpsafer.com. Removing a site in the panel deletes its FTP/SFTP details immediately and stops all scheduled work; the site record and its access key are kept in the Trash in your panel so that the site can be restored — you can delete them permanently at any time, and if you don't they are deleted automatically after 90 days. The access itself ends as soon as you change the key on the site or remove the WP Safer plugin. Deleted backups move to the Trash in your panel, where you can delete them permanently at any time. On account closure, the site records, access keys and all remaining backups (stored with DigitalOcean Spaces) are deleted within 30 days.
• We may suspend or terminate your account for breach of these Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. Any disputes are subject to the exclusive jurisdiction of the courts and execution offices of Istanbul (Kadıköy); users qualifying as consumers may also apply to the competent consumer arbitration committees/consumer courts under applicable law.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to your registered email address.
